10514 Competitive Negotiation

Competitive Negotiation  - is a method of contractor selection, which includes the following elements (the emphasis is placed on quality rather than price):

When selecting a firm for professional and consultant services where the compensation for such professional services is estimated to exceed $100,000, the Commodity Team, selected by the Director of Administrative Services and to include at least one user, will evaluate and make a recommendation to the Manager of Purchasing & Contracts.

The Commodity Team shall select no less than two firms, if available, deemed to be the most qualified to perform the required services after considering such factors as the ability of professional personnel; past performance; ability to meet time and budget requirements; location; recent, current and projected workload of the firms; and the volume of work previously awarded by Georgetown with the object of effecting an equitable distribution of contracts among qualified firms, provided, however, that such distribution does not violate the principle of selection of the most qualified firm and consideration of their ability to meet time requirements.   

1. Issuance of a written Request for Proposal indicating in general terms that which is sought to be procured, specifying the factors which will be used in evaluating the proposal and containing or incorporating by reference the other applicable contractual terms and conditions, including any unique capabilities or qualifications which will be required of the contractor.

2. A Georgetown University notice of the Request for Proposal may be posted at least five days prior to the date set for receipt of proposals by posting in a designated Georgetown University area or by Georgetown University in a newspaper of wide circulation or both
3.    Selection shall be made of two or more offers deemed to be fully qualified and best suited among those submitting proposals, on the basis of the factors involved in the Request for Proposal, including price if so stated in the Request for Proposal.
4.    Purchasing and Supply Management (P&SMA), with the aid of the Commodity Team, shall negotiate a proposed contract with the highest qualified firm for the professional and consultant services required. The firm deemed to be the most qualified will be required to disclose its fee structure during negotiation. If a satisfactory proposed contract cannot be negotiated with the highest qualified firm, negotiations with that firm will be formally terminated. Negotiations shall then be undertaken with the second most qualified firm. Failing accord with the second most qualified firm, negotiations shall be terminated with that firm. Negotiations shall then be initiated with the third most qualified firm and so on until a satisfactory proposed contract is agreed upon.
